Welcome to CXMetricWorks. These Terms of Use (“Terms”) govern your access to and use of https://azimsweb.com/ and the calculators, templates, guides, articles and other resources made available through the website (collectively, the “Services”).
The Website is operated by Mohd. Azimuzzaman Siddiqui, trading as CXMetricWorks, from New Delhi, India (“CXMetricWorks”, “we”, “us” or “our”).
Please read these Terms carefully. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About the Services
CXMetricWorks provides practical tools and resources for BPO, contact-centre, quality-assurance and customer-experience professionals. These may include:
Weighted QA scorecard calculators
Quality-evaluation and coaching resources
Performance and KPI calculators
Templates, guides, articles and downloadable materials
Additional tools introduced in the future
Some Services are currently provided free of charge. We may introduce paid products or services later. Any paid service may be subject to additional pricing, payment, cancellation or licence terms presented before purchase.
2. Eligibility and Authority
You must be legally capable of entering into a binding agreement to use the Services. If you use the Services on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.
The Services are designed primarily for professional users and are not directed to children under 18 years of age.
3. Permitted Use
Subject to these Terms, CXMetricWorks grants you a limited, non-exclusive, non-transferable and revocable right to access and use the Services for:
Personal learning and professional development
Internal business and operational purposes
Quality evaluations, coaching and performance analysis
Creating and printing results for legitimate internal use
This permission does not transfer ownership of the Website, its tools, designs, code, branding or original content to you.
4. Your Responsibilities
When using the Services, you agree to:
Provide accurate information where information is requested
Review calculations and outputs before relying on them
Apply your organisation’s approved policies, scoring rules and quality standards
Comply with applicable laws, contracts and confidentiality obligations
Obtain any permissions required before using employee, agent or customer information
Maintain appropriate records and independent backups of information important to you
You are responsible for decisions made using the Services and for determining whether a tool or output is appropriate for your process, organisation and circumstances.
5. Confidential and Personal Information
Do not enter real customer names, telephone numbers, email addresses, account numbers, payment information, health information, authentication details or other confidential or sensitive information into our free tools.
The QA Scorecard Calculator is designed to perform calculations in your browser. CXMetricWorks does not intentionally store calculator entries unless a tool clearly states otherwise or you separately submit information through a contact form or another feature.
You remain responsible for complying with your employer’s data-classification, privacy, security and confidentiality requirements. CXMetricWorks is not responsible for information you enter contrary to these Terms or your organisation’s policies.
6. Accuracy and Professional Judgment
We aim to make the Services useful and reliable, but we do not guarantee that every calculation, formula, template, recommendation or result will be complete, error-free or suitable for every process.
Outputs may be affected by the information, parameters, weights and scoring selections entered by the user. You should independently verify important results before using them for coaching, performance decisions, compliance reporting, disciplinary action or client reporting.
The Services do not replace professional judgment, approved organisational procedures or advice from qualified legal, financial, HR, compliance, data-protection or other professional advisers.
References to industry practices, quality frameworks or terms such as COPC do not mean that CXMetricWorks is affiliated with, endorsed by or certifying compliance with any third-party organisation or standard.
7. Prohibited Use
You must not:
Use the Services for unlawful, fraudulent, harmful or deceptive activity
Attempt to gain unauthorised access to the Website, servers, accounts or systems
Introduce malware, malicious code, automated attacks or disruptive traffic
Scrape, crawl or extract Website content at an unreasonable scale
Copy, reverse-engineer, decompile or reproduce the tools or their source code, except where applicable law expressly permits it
Resell, sublicense, republish or present the Services as your own product without written permission
Remove copyright, trademark or attribution notices
Use CXMetricWorks branding in a way that suggests sponsorship, affiliation or endorsement without permission
Use the Services to violate another person’s privacy, intellectual-property or contractual rights
Enter confidential employer, employee or customer information without proper authority
Use the Services to make solely automated employment or disciplinary decisions without appropriate human review
8. Intellectual Property
The Website and its original content, branding, graphics, layouts, calculators, interfaces, code, templates and documentation are owned by or licensed to CXMetricWorks and are protected by applicable intellectual-property laws.
“CXMetricWorks,” its logo and related visual elements are CXMetricWorks brand assets. No licence to use these assets is granted except as necessary to access the Website normally.
You may use results legitimately generated through the tools for your personal or internal business purposes. You may not copy or commercially distribute the underlying tool, interface, formulas presented as proprietary functionality, or branded templates as a competing or white-labelled service without written permission.
9. User Submissions and Feedback
You retain ownership of information that you submit through contact forms or feedback channels. You grant CXMetricWorks permission to use that information only as reasonably necessary to respond, provide support, operate the Services and comply with applicable law, in accordance with our Privacy Policy.
If you voluntarily provide suggestions or ideas for improving the Services, we may use them without restriction or payment, provided we do not publicly identify you without permission.
You confirm that anything you submit does not violate another person’s rights or contain unlawful material.
10. Third-Party Services and Links
The Website may contain links to, integrations with or content from third-party services. These third parties operate under their own terms and privacy policies.
CXMetricWorks does not control and is not responsible for the availability, security, accuracy, products, services or practices of third-party websites. A link does not necessarily imply endorsement.
11. Availability and Changes
We may update, improve, suspend, restrict or discontinue any part of the Services at any time. We do not guarantee uninterrupted availability or that every feature will remain free.
We may perform maintenance, correct errors, change tool functionality or impose reasonable usage limits. Where practical, we will try to avoid unnecessary disruption, but we are not obligated to preserve any particular feature or version.
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. CXMetricWorks does not make warranties, express or implied, regarding uninterrupted availability, merchantability, fitness for a particular purpose, accuracy, non-infringement or compatibility with your systems or requirements.
Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
13. Limitation of Liability
To the maximum extent permitted by applicable law, CXMetricWorks and its operator will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, business opportunities, goodwill or data arising from or connected with your use of, or inability to use, the Services.
CXMetricWorks is not responsible for employment, coaching, disciplinary, compliance, client-reporting or operational decisions made using tool outputs.
For free Services, our total liability for claims relating to the Services will not exceed ₹1,000, except where liability cannot legally be limited or excluded. If you purchase a paid Service, any different liability limit stated in the applicable additional terms will apply.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold CXMetricWorks and its operator harmless from third-party claims, losses or reasonable costs arising directly from your unlawful use of the Services, your violation of these Terms or your infringement of another person’s rights.
This provision does not apply to the extent that a claim results from CXMetricWorks’ own unlawful conduct.
15. Suspension and Termination
We may suspend or terminate access to the Services where we reasonably believe that a user has violated these Terms, misused the Website, created a security risk or caused harm to CXMetricWorks or another person.
Provisions that by their nature should continue after termination—including intellectual property, disclaimers, liability limitations, indemnity and governing law—will remain effective.
16. Privacy and Cookies
Our collection and handling of personal information are described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy. Those policies form part of the rules governing your use of the Website.
17. Changes to These Terms
We may update these Terms when the Services, business practices or legal requirements change. The revised Terms will be posted on this page with an updated “Last updated” date.
Material changes may be highlighted through a Website notice where appropriate. Your continued use of the Services after revised Terms take effect means that you accept the updated Terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory rights or remedies available under applicable law, disputes relating to these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
Before starting formal proceedings, you and CXMetricWorks agree to make a reasonable, good-faith effort to resolve the dispute by contacting the other party and allowing at least 30 days for a response.
19. General Provisions
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our written permission. We may transfer our rights and obligations in connection with a reorganisation, transfer of the Website or sale of the business.
These Terms, together with the Privacy Policy, Cookie Policy and any additional terms presented for a specific Service, constitute the agreement between you and CXMetricWorks concerning your use of the Services.
